Title A Study on Defense Intellectual Property Strategy based on Modular Open Systems Approach (MOSA)

Abstract The South Korean defense industry is adopting the Korean Modular Open Systems Approach (K-MOSA) to overcome the high costs and vendor lock-in associated with traditional monolithic systems. However, current domestic R&D regulations, characterized by state ownership or complex joint ownership, may discourage private sector participation due to concerns over intellectual property (IP) leakage. This study analyzes the U.S. Department of Defense's and NATO's MOSA strategies, focusing on the "Doctrine of Segregability" and "Mixed Rights Strategy" under DFARS, as well as the IP policies of the FACE and SOSA consortia. Based on this analysis, the paper proposes a "K-MOSA IP Strategy" tailored to the Korean context to balance public acquisition goals with private incentives. Key recommendations include legislating an "IP Segregability Principle" to determine ownership at the module level rather than the project level, introducing a "K-Data Rights" system that incorporates Government Purpose Rights (GPR) and Black Box protections, and establishing a "Korea Verification Authority (K-VA)" for third-party verification. These measures secure government control over system architecture while protecting private core technologies, thereby providing predictable business incentives to private firms and a flexible acquisition environment free of vendor lock-in to the government, ultimately fostering a sustainable defense R&D ecosystem and reinforcing the strategic foundation for the K-defense industry's global competitiveness.
