Abstract In accordance with recent betterment of living quality, it is real condition that the dispute related to environmental damage which occurred by industrial development together with enlargement of the people's desire for a pleasant environment are increasing tendency. Especially, since this contains many difficult cases for minute examination on certain causal sequence, government had organized National Environmental Dispute Resolution Commission in 1991 for the purpose to relieve the environmental damage dispute promptly and fairly by intervention positively to the environmental dispute, such system was made for salvation of people's health and financial damage owing to environmental pollution, and is now able to be relieved by the administrative organ's prompt and fair grievance resolution. This study progressed in the National Environmental Dispute Resolution Commission among 1750 trouble affairs in 1508 trouble affairs with the noise and vibration since 1993 in 2007. As a result to deal the trouble adjustment from a construction noise and vibration efficiently, each other between position difference recognition do recognition conversion necessary. Therefore, this study would like to present the elementary material for the formulation of an effective countermeasure when any civil appeal was filed in the future, by conduct of analysis about the mediation case on damage dispute concerned with the constructional noise and vibration among such environmental pollution damage disputes.
