Abstract |
The goal of this study is to understand the issues of a negotiation process for settling conflicts with local residents who are on constraints of private property rights in the process of preservation or development of Pungnaptosung(Mud Rampart), which is designated as a cultural property protection zone. Until now, however, pre-negotiation has proceeded although the goals and the stakeholders of the negotiation were not clear. In addition, the facts that the compensation of specified lands has been processed depending on the landowner's application without any comprehensive plan and the acquired lands have been improperly managed result in complaints and conflicts of the community and residents. Therefore, this study tried to find the issues and the policy implications by analyzing the negotiation structure in the process. To do so, it analyzes the negotiation power between the negotiating parties and the change of the Win-set and ZOPA(zone of possible agreement) based on the Habeeb's Theory. The conclusion of this study is expected to predict the dynamic flow of negotiation through the form and change of the Win-set and ZOPA in the negotiation process, which is subject to the power imbalance of negotiators. |
