Abstract Urban green spaces are essential infrastructure that provide climate regulation, social welfare, and economic benefits, playing a vital role in sustainable urban development. However, current methods of providing green space have structural limits, such as unfair distribution, rigid classification systems, and restricted decision-making. These issues conflict with constitutional values that guarantee equality, the pursuit of happiness, and environmental rights for all citizens. Accordingly, this study aims to redefine green spaces as a democratic right of citizens rather than just physical objects. To achieve this, the study verifies the importance of their various values and analyzes philosophical and urban theories to establish a theoretical basis. The democratic right to green space forms an interconnected system of ‘Green Sovereignty’, ‘Green Equality’, and ‘Green Liberty’. This framework suggests a shift toward guaranteeing civic participation, equity, and the freedom to use urban green spaces as fundamental democratic rights.
