Abstract |
Reports on population movement(2000-2030) by the National Statistical Office show that the number of elementary school age population will be decreased by 1.4million from 2005 to 2020. Nevertheless, the needs of new school have been required due to a lot of new city and housing developments. It may follow new community without a school, increase the inequality of school facility service and bring press on the local finance. 『The exemption law of securing school land』 was enacted in 1995 for securing school lands in new housing development project. But the Constitutional Court decided in 2005 that it is against the constitution with the legal principles such as the principles of compulsory education and the principles of proportion. This study reviews the problems of the law and exaction system at present, and then explores the development impact fees and school impact fees in America, which is defined as a monetary exaction charged by a local government agency to an applicant in connection with approval of develop project for the purpose of defraying a portion of the cost of school facilities related to the development project. With comparative study on school land fees in Korea and school impact fees, this study suggests to apply the exaction system based on cost accounting approach, the rational nexus test and the citizen's participation in the exaction processes. |
