| Abstract |
The purpose of this study is to improve the compensation system related to Extension of Time (EOT) in domestic public construction
contracts in Korea. The general conditions of contract under the National Contract Act lack explicit provisions distinguishing compensation
scope ? including EOT, cost, and profit ? by responsible party. A comparative analysis was conducted between domestic contract conditions
and the FIDIC Pink Book (Multilateral Development Bank Harmonised Edition, 2010). Interpretive Structural Modeling (ISM), MICMAC, and
Fuzzy ISM were applied to 25 delay factors derived from both contract conditions, based on a Focus Group Interview (FGI) with 12 experts.
The results were as follows: all delay events should be categorized as compensable, excusable, or non-excusable, with compensation range
explicitly stipulated in respective sub-clauses. ISM and MICMAC identified delayed drawings, unforeseeable physical conditions, and quantity
changes as key driving factors. This study proposes explicit codification of compensation scope by responsible party and expansion of cost
compensation concepts aligned with FIDIC standards. |
